    Additional terms Affiliate Guidelines These Guidelines apply to individuals and organizations who or which endorse SomniFix products on a blog, podcast, video, social media site, or other outlet under a Brand Ambassador Agreement with SomniFix (each, an “Ambassador”). The Federal Trade Commission (“FTC”) has certain requirements pertaining to endorsers who obtain payment, free products or other compensation from a company in connection with the endorsement or promotion of its products. These Guidelines are meant to assist Ambassadors in complying with the FTC’s and other legal requirements, and apply to use of social media, social networking, podcasts, websites, live events and other advertising and communication channels. SomniFix wants to make sure that consumers are aware of the relationship between each Ambassador and SomniFix. • An endorsement includes any message (written, verbal, video, etc.) about a SomniFix product that a consumer is likely to believe reflects the opinions, beliefs or experiences of the Ambassador. • All endorsements must reflect the actual views and honest opinion of the endorsing Ambassador. Endorsements may not be false, deceptive or misleading in any manner. Endorsements must be based on personal experience, and must reflect typical consumer experiences. • All endorsements must include disclosures of the Ambassador’s relationship with SomniFix. o For any written endorsements (including but not limited to online reviews and blog posts), the disclosure should be posted near the endorsement in a clear and conspicuous manner. Do NOT use vague language (such as “Thank you SomniFix”). Rather, the language of the disclosure should be plain and unambiguous. For example:  “SomniFix gave me this product to try….”  “SomniFix sponsored this post…”  “This is a paid promotion”  “I get commissions for purchases made through this link.” o For videos and podcasts, the disclosure should be at the beginning of each video containing an endorsement of SomniFix’s products, and should be repeated at various times throughout the video if it is lengthy.  Again, the disclosure can be as simple as “SomniFix gave me this product to try ....” Another example disclosure, “Some of the products I’m going to use in this video [discuss in this podcast] were sent to me by SomniFix.”  If the disclosure is displayed on-screen in a video, it should be on the screen long enough to be noticed, read and understood; if the disclosure is spoken, it should be stated so that it is easy for consumers to follow and in words consumers will understand. o For social media, any of the following hashtags may generally be used: #Sponsored, #Promoted, #Promotion, #Paid ad, #Paidfor; on Twitter, starting a tweet with “Ad:” or using #ad is sufficient.  For social media sweepstakes and contests, entry hashtags must include the words “sweepstakes” or “contest.”  Hashtag disclosures must be prominently placed (NOT in the middle or at the end of a series of hashtags).  If a sponsored social media post is long and is cut short by a “more” button that users need to click on to see the full post, the disclosure should show above the “more” button in the lines that are initially visible to the user.  Disclosures must be made each time when including previously sponsored products/services in successive posts.  Do NOT use ambiguous hashtags such as #Spon, #Sweeps, #Sp, #Partner. o For in-person appearances or interviews, the Ambassador must disclose his/her connection to SomniFix if that connection would not be obvious to consumers in context. • Social media platform-specific guidance: o On YouTube, include disclosures as a clear and legible written overlay on the video itself, not just in the written description. Any written disclosures must be on screen long enough to be read and understood. Additional verbal disclosures are also recommended. Disclosures should be as close to the beginning of the video as possible, and may need to be repeated throughout for longer videos. o On Instagram, superimpose the disclosure on Instagram Stories and place disclosures at the beginning of the description and before the “more” button. If SomniFix is tagged in the post description, it must be clear that it is tagged as a sponsor. o On Twitter, #ad or #paid at the beginning of a Tweet is preferred. o On Snapchat, disclosures must be in the first Snap of any Story and should be superimposed on any sponsored Snap in clear, legible text and verbally disclosed as well for video content. o For Blog Posts, state “This post is sponsored by SomniFix” at the beginning of the post (i.e., it is not sufficient to only use hashtag disclosures at the end of a post). o On Facebook, make disclosures at the beginning of any post, include disclosures as a clear and legible written overlay to any video content, and make disclosures clear when tagging SomniFix in a photo. • A link to a disclosure is not sufficient; nor is a single disclosure on a website if it is not clearly and conspicuously presented with each endorsement posting or video. For endorsements made on YouTube or other video-sharing sites, the disclosures must be part of the video itself; it is not sufficient to put the disclosure only in the video description. Remember, as an Ambassador, you are representing SomniFix, so we ask that you maintain a professional approach, and avoid all of the following: defaming or disparaging others; making misstatements; using obscenity or profanity; encouraging violence or violation of the law; engaging in any behavior that could be considered unlawful, threatening, bullying, harassing, discriminatory, hateful or racially or ethnically offensive. Please keep in mind that SomniFix reserves the right to monitor any endorsements of its products or those of others that you incorporate within your content. SomniFix reserves the right to cancel any sponsorship or other relationship with you relating to the endorsement of SomniFix products, including if you violate this Policy, the FTC requirements, or applicable law.
